    Insurance agent form other company after father's death.

    My father died in a car accident on Jan 5. The insurance agent from the other company is calling us telling us he has 100,000 dollars to distribute. Although my father turned into on-coming traffic- his client was speeding. Does this sound right? Is the insurance agent trying to disingenuously get info from us or is this real?

    It sounds like they are trying to head off a wrongful death suit by the estate and are offering the amount in settlement.

    I am not sure what you mean by 100,000 to distribute. I would recommend consulting with a personal injury/wrongful death attorney.

    "Legal" raises the issue. Your post makes no sense. Often, a party is in distress after an incident and hears what they want to hear or interprets words incorrectly.

    In this case, the agent is cutting his own throat (legally) as an interested party to his client (the insurance company he represents). That is, the other party is vicariously making an admission of guilt. Makes no sense.

    You are inferring comparative negligence. The other party's insurance agent has no authority to make such an inferrence and offer settlement which is what I believe is happening here.

    Get an attorney familiar with insurance law and NEGLIGENCE. This needs to go to litigation and YES, you likely have a wrongful death action which raises punitives, The other party's insurance company is likely attempting to avoid this like the plague.

    The point is that the insurance agent's interference creates a complicated chain which will require a compitent attorney. Go Gettum and good luck.

    My family went through a similar situation dealing with a car accident where both parties were partially at fault. I can say from experience that dealing with insurance companies can be confusing and frustrating. I would agree and say your best bet would be to hire a wrongful death attorney.
