    What are slip and fall settlement amounts?

    Does anyone know what the average amount of money would be awarded to the winner of a slip and fall settlement? I was telling my friend about this website the other day and she said that her mother had fallen down very hard on a concrete sidewalk by our house. The sidewalk is in very bad shape, and she has already had one surgery as a result of the fall.

    I'm curious as to a dollar amount, and would the money just basically go to cover her medical expenses or would she really be able to get anything out of it for herself? It just seems like she's really been down and out because of this, and she isn't even overweight, she has really been hurt by this.

    Well, it's hard to really nail down any an average settlement for slip and fall injury cases. By some estimates it would range between $20-50k.


    This is because the average slip and fall settlements are not just determined by a single factors. A group of factors, not unlike any other personal injury situations (See that link for a bunch of different kinds of personal injury cases because I can tell you're curious.) In a normal slip & fall case, a victim has to prove the accident happened because of negligence on the part of the owner of property. In this case, the owner is probably going to be the city.
    When someone gets a personal injury settlement (whether it's from slip and fall or from any other type of accident) the amount of money they can get will depend on how steep the medical costs were for the injuries. But it isn't going to be cheap these days because healthcare for injuries is rising all the time. In fact, sometimes if a victim goes through a lot of pain like you're describing for your friend's mom, she may be paid to compensate for that, too.
    So the slip and fall damages can run into large dollar amounts, but getting a settlement to cover medical costs, as well as to cover suffering like I mentioned and also for lost wages. But when it comes down to it, the victim is really mainly going to generally be looking to be compensated for what's been lost as well as what could potentially be lost in the future as a result of a slip and fall.
    Also, another thing to consider with regards to most slip and fall accidents is that if your friend's mom was carrying any kind of personal property during the accident like a laptop (unlikely) or maybe a cell phone (likely) and this was damaged during her accident, then she'd generally be represented by an injury lawyer to cover things like this as well.     I will say this, I do think it will be harder for your friend's mom to get money out of the city, they are usually harder to work with and they have laws that they create to specifically protect themselves and make it hard for people to sue them. But regardless, it's important to document everything. For example:

    1. She should keep all the stuff about her accident like reports as well as any other medical paperwork.
    2. She should absolutely keep very detailed medical expenses history with all the paperwork. This includes the cost of travel.
    3. She should also make sure to keep record of the lost wages from work.
    4. If she wants to know whether she can be compensated to pay for all her doctor's bills, which she probably can be, she should talk to a slip and fall attorney as soon as she can. Here's a list of slip and fall attorneys in all 50 states, but I forgot to ask, what state are you located in? Or more specifically, what state is your friend's mom located in? And the city...because she can look up lawyers here: Personal Injury - Lawyers & Attorneys. She shouldn't wait because some states make it so that a person loses rights and can no longer file a claim after a certain amount of time has passed.

    But I guess for the average settlement amount for slip & fall it should be looking at between $20,000 to $50,000 which is going to depend a lot on the specific circumstances of the fall as I mentioned earlier.

    According to that article, you'll note that experts tend to place a value of $40,000 on the average claim. But all that represents is an average. Most people are not going to get the average...they're going to be above and below that amount.

    Damage amounts are typically a function of the total medical bills. In my experience, settlement amounts range between 2-4x the total bills, depending on the jurisdiction, likelihood of future treatment/disability, etc..

    This varies from case to case. The primary factor in the amount of the settlement is the percentage of fault of the defendant: the greater the percentage the defendant is at fault, the greater the settlement amount.
