    product liability

    Hi.I was inside store and they ware giving samples, energy drink... 10 min. later I end up in ER for dizziness, palpation, stomch pain etc.. now I have the hospital bills almost $10k the co. said will pay for it... but I want to sue them for the stress, 6hours under medication, and most of all I could have risked of dying, the Dr. said I could have pass out etc.... I just don't know how much I should sue them... maybe I'm thinking $1.5mi is that fare enou

    Hi Sempreio, can you give more details like what the name of the energy drink, what the contents of the energy drink were. Were you allergic to the drugs, have an allergic reaction, or anything else? Have you spoken with a personal injury attorney regarding the drink and also have you spoken with the company themselves at all?

    It's important to speak with a lawyer right away because the statute of limitations could pass and you could forfeit any right to sue. Now, as to the question of how much money you can get in the injury lawsuit, it's hard to say, but I would say that you're probably a far cry from getting $1.5 million for it. First of all it would be important to know whether you have any lasting medical conditions as a result of your injury.

    So in summary:

    1. Do you have any lasting physical injury?
    2. Have you spoken with an injury lawyer?
    3. Have you spoken with the energy drink's manufacturer?
    4. Did you incur other medical bills?
    5. What state are you located in where the personal injury occurred?

    It is vital that you contact an attorney specializing in personal injury law. I do agree with vflores619 that the lawsuit most likely will not reach $1.5 million; however, I still would get in touch with an attorney.
