    Cival suit and bankrupcy

    I have been sued and the court set a trail date in week. I am also in the process of using a free legal service provided by Houston Volunteer Lawyer Program for bankruptcy. They are in the processes of assigning us a lawyer. Should I send the court a postponement letter. Would it do anything to explain to the court that I am in the process of filing and the trail will be a waste of time or should I just keep trying to postpone. If I postpone what would be a good example of what I should send them. Thank you

    You should consult with the lawyer you were appointed for by the Houston Volunteer Program and he will let you know how it is best to proceed with the bankruptcy. It may be better for you to wait until the trial is over before filing bankruptcy but it really depends on many different facts and circumstances.

    Thank you but my problem is that the lawyer hasn't been assigned yet and it will most likely be a couple weeks. Because we just finished paying the filing fees. Once we pay fees then a lawyer is appointed. Thank you.
