(inviteid:3547736873) I'm trying to find some legal help.
Vivian says:
Hello Visitor. My name is Vivian how can I help you?
Vivian says:
what's going on?
Visitor On legalhelp.org says:
I sent my truck to be fixed by a mechanic back in Sept. I gave him the money for the motor in Sept. and he told me it would take 3-4 weeks to have it ready. I have yet to get my truck back.
Vivian says:
do you have a contract with mechanic?
Vivian says:
have you paid anything yet?
Visitor On legalhelp.org says:
We don't have a written contract. I have paid $2568 to order a remanufactured motor.
Visitor On legalhelp.org says:
The check cleared Oct. 2.
Vivian says:
Oh wow
Visitor On legalhelp.org says:
Yes.
Visitor On legalhelp.org says:
Exactly.
Vivian says:
okay well, what is the mechanic saying?
Vivian says:
I suppose they're giving reasons?
Visitor On legalhelp.org says:
On Oct. 29 he stated that the machine shop he was getting it from was running behind & it would be ready in 2 weeks. On Nov. 13 he stated that the machine shop was running behind because they were investigating the engine problem & that it would be ready in 2 weeks. On Nov. 29 he said that the machine shop was running behind and offered to get a used engine with a 90 day warranty and save me $700.
Visitor On legalhelp.org says:
On Dec. 3 he said that he would get the used motor which I approved and have it ready. That same day I told him I wanted my truck back with the new motor in it & running well or I wanted my money back.
Visitor On legalhelp.org says:
On Dec. 5 he stated that he he would pick up the engine Dec. 7 from Beaufort and have it ready by the 14th. On Dec. 13 he called and told me that I needed an intake manifold. I told him to go ahead and purchase it with the $700 that he had saved me.
Visitor On legalhelp.org says:
I called the place he was getting the intake manifold and they stated they could have it by the next morning if the call was made before 2:30 and the price was $312.70.
Vivian says:
so he sounds like he's kind of stringing you along?
Visitor On legalhelp.org says:
I called the mechanic on the 14th and he said that the part hadn't come in and it would be Monday.
Visitor On legalhelp.org says:
Exactly.
Visitor On legalhelp.org says:
For almost all of our conversations I have had 1-2 people listening on the phone or in person.
Vivian says:
so has the mechanic actually shelled out your money yet?
Visitor On legalhelp.org says:
No he has not. The truck is still in his possession.
Visitor On legalhelp.org says:
So legally I'm not sure what to do at this point.
Vivian says:
well, it's a difficult situation but it comes down to whether you want to legally force him to return the money or if you want performance
Visitor On legalhelp.org says:
If he has the engine I just want the truck fixed but if he doesn't even have the engine then I want my original motor back in my truck and my $2568.
Visitor On legalhelp.org says:
I just don't know what to do basically.
