    Debt Collection Harassment

    About 4-5 years ago my husband and I took out a loan with Innovations credit union for around $11000. My husband lost his job and they repoed the vehicle sold it at auction and got somwhere around $6000-$7000 back then sued use for $11,430.54 with an interest rate of 6% back in 2010. Then last year they came and got our personally owned vehicle I found out about an exemption which I used to get it back that truck broke down and we traded out for one even older that the last one, so today they came and got that truck just going through a different county. I am going to file the papers for the exemptions using FS 222.25, but I need to know what laws I have on my side for excessive harassment becuase I was under impression the exemption covered all of Florida and this is our only means of transportation for a family of 7. Plus my husband already struggles with PTSD and some depression so this is causing physical and emotional stress that is really unnecessary! I can do this myself I just need to know what forms and statutes I can use in our favor. Thanks, Jen.

    Your biggest problem is you have continued to not pay your bills. You can continue to seek creative ways to thwart their attempts to collect, however, the bill and collection efforts will continue. We are not here to assist you defraud another for debts you owe. I suggest you stop buying trucks. You will pay less for vehicles and less for gas, freeing up money to pay bills with.

    I am not sure if what they are doing would qualify as excessive harassment. They probably came after your second truck because they did not know it was exempt. You should just do the same thing you did with the first one to get it back.
