I asked an auto repair shop to go through my van from stem to stern and repair or replace everything that needed to be fixed. My bill was over $2000. One week after picking up the van, the van stopped, had to be towed, and the new repair shop found that the fuel pump and filter were bad and needed replacing. The new bill for this repair was over $800.00. I returned to the original auto repair shop to request compensation for the $800 I had to pay the 2nd repair shop. They refused to pay and tried to explain away why they had not replaced the fuel pump and filter. I sent an email to the corporate ofc via their website; received an email saying someone would contact me about the issue,,no one every did; business has F rating with BBB; called owners of local franchise--no one ever answered my call...no response period. Do I have a solid basis to file a small claim against the original auto repair shop?

You may have a case but it depends on many factors, including their reasoning for not replacing the fuel pump and filter, whether there was any negligence involved, etc... For example, if they determined that the fuel pump and filter needed to be replaced and that would cost approximately $800, it would have been the same cost for you. To me it appears that you basically split up the work between 2 mechanics. 1 mechanic did part of the job for $2,000, the other did the rest of the job for $800. In order for you to win in small claims court, you will need to show why they are responsible for that other $800.

Fuel pumps do not give warning prior to going out. Fuel filters should always be changed at the time a new pump is put on. If you want a new car, buy it. Do not expect an old one to perform like a new one. Had they completely overhauled the vehicle and given you a repair bill for $50k, you would not have been happy either.
