    Gifted testing

I paid for gifted testing $500.00 a month ago and that person's report is not accepted by school because evaluation should have been done after jan 2012! I called the person who took the gifted testing and told him that why dodn't he let me know about this change in policy. In responce he told me that he himself was not aware about it. and he is refusing to refund money or not willing to take her test again for free! he is asking another 250$ It is completely not my fault and he is responsible for not knowing the change in policy. what should i do? my daughter is gifted with an IQ of 131 accourding to the test he conducted just a month ago. But that test will not be valid as it should have taken place after jan 2012! what should i do?
