Abused wife does not want him back

    Hello,

My girlfriend's husband is being paroled to her in the state of Texas. We cannot afford the divorce at this time and I am hoping for some advice. I understand if no one can, but we would really appreciate any help we can get. She lives in Kermit, Texas and I live in Carlsbad, New Mexico. He is already out on parole and for some reason they have decided to move him to her house. She absolutely does not want him there. He beat her and their kids, he would rape her and even did it in front of the children. I am stuck here because of my job and my place is not big enough for all of us although if it would prevent him from being able to get near her, we would manage. Is there any way we can stop this from happening?

    Thank you,
    Michael

She needs to file a restraining order against him. I don't see how the court could allow this. You need to contact the court and let them know the circumstances in case it was overlooked. Also just to make sure, is the house in her name or his (or both)?

She rents her house so it is not in either of their names and he never lived there, she moved there after he went to jail. The abuse was not recent and she does not have any proof but we will attempt to get a restraining order.

Honestly I don't see how they could force her to allow him into his house. If he shows up there, I would call the police (and the news media).
