    getting a copy of police report

    I am trying to get a copy of my police report. I was cited for drunk in public, that is what is on the citation.However when i recieved my notice from the D.A's office it says i'm also being charge with resisting arrest. I called the station that i was arrested at and they told me that i all the ticket described was drunk in public the referred me to the records department which would not release the report. I also called the D.A's office the would not let me have a copy either. How do i go about getting a copy before my arraignment, without the assistance of a lawyer.

    Why did the records department refuse to release the police report? How long after this happened did you try to get it? Sometimes it can take a few weeks to obtain the police report.

    I get very pissed when I read posts such as yours. It seems that we have a closed circuit of police/DA office/local attorneys. Outsiders are barred from this inner sanctum. Remember older cases where patients had no access to their medical records unless they were a doctor?

    Modernly, it seems that simple government employees think only lawyers and other "agents" of the Court are entitled to court & arrest records. Explain to the records department that you are acting Pro Se in this case and require the Police Report in order to prepare for a hearing on (such date). Be polite but firm.

    If they refuse, you have a really good suit based on your civil rights under the Constitution's equal protection clause and procedural due process.

    After getting the police report you should know what is your situation at that time and you can represent your self in a better way in the court.
