    Theft & Fraud

    My brother has a gambling addiction. He recently wrote a check from one account to another and get the cash is gamble. He racked up a hefty bill. He contacted the banks and set up payment arrangements to pay it back. One bank said they had to file a police report for the purposes but no charges would be filed. He was just arrested two days ago for theft, identity theft and fraud. We are not sure where the identity theft came in at. He was arrested 3 years ago for taking a co workers check & trying to cash it. So he was charged with theft & identity theft then and got 1 year probation. He can't afford an attorney, what are his chances of not going to prison for this?

    What state are you in? Have you talked with the court about a public defender? What kind of details do you have about his actual situation and the reasons that led to his being arrested? Without knowing more details it's hard to have a basic idea of his chances for not going to prison.
