    Question About pre trial rights?

Is a violation of my rights for the courts to make me take a breathe test twice a day, due to the fact I am innocent until proven guilty? Also if proven innocent do I get all the money paid toward the test back?

What state? And why are they mandating twice daily breathalyzer tests? And is it court mandated?

Yes it is court mandated in Montana. Pulled over and arrested for D.U.I. only because I denied to take a breath test at the time.

Have you had a look at the laws regarding breathalizer tests in the state of Montana? Montana DUI Laws | DUI DWI Legal Help

I was also looking at some of the ratings and there were several DUI law firms located in Montana which have the reputation for helping people out with these kind of legal issues to a high degree of success in dismissing or significantly reducing the long term impacts for DWI charges in Montana. For example, Foust Law Office in Bozeman is rated quite well, and there are hundreds of others listed. You could take a look here as well for the list of Montana DUI Lawyers who provide help to people who are needing to resolve these issues. Many offer their services pro bono to folks with low income.
