    Unlawful Termination By Wal-Mart

    I wanted to know if I had a case. Here is the deal I was terminated from Wal-mart for what they call time theft and I never stole a thing in my life. Wal Mart has a policy where the employee can go to a computer and change his or her time any time of the day, if used that time to work. I provided customer service after I clocked out for lunch and took the time I spent helping the customer extra on my lunch,As told I can do that by managment.

    When I got back to the store I told a memeber of managment even though I did not have to, that I helped a customer as I was heading out to lunch and took that extra time on my lunch and so I would need to make a change on my time.( I assumed I was coveing myself incase somthing came up). guess not. they got angey at me everytime, and told me just to go and change my time.

    being that I am a profecionest I like to make sure all my work was done before I sit down. I would have to sit to change my time. Being that I was constently overworked given way to meny jobs to do before my shift was over I never got to the computer those days I needed to ajust my time. So I got to the computer one day after I clocked in and before I was givin stuff to do and changed my time for those days. I then told a manager that I ajusted my time for those days today. same manager I told that I needed to ajust my time. and then the whole time theft came up

    I asked for prove before I left and they told me that they could not let me see any prove at the time they told me they had videos of me coming in to the store from lunch, I asked to see those and they refused to show me so I then left the store with no prove showen to me. Except for dates.

    I took the first step and filed for unemployment, after some time I got my unemployment only to find out about 3 months later after getting the first check that Wal-Mart decided to appeal though a on the phone trial the arbatrator found in my favor stating that Wal-mart did not have prove as to why they fired me they gave the arbatrator a list of call-outs that I did thoughout my 4 years of employment along with my attendence record. none or witch applys to the issue. In that appeal I denied ever stealing time I stated that the times I ajusted was the time I used before leaving the store for lunch after I clocked out and had talked to a manager once I got back on the days in question. Wal-mart asked me why I did not reveal that in the exit interview and I told them to be honest I was scared and nervous in the office where they told me that they were going to fire me the main thing on my mind when hearing the word fired is how am I going to pay my bills in live with no money. Do I have a case? O and I live the in the of Florida

    I do not believe you have a case. Florida is an "at-will" state and you can be terminated for almost any reason (unless its discriminatory). Walmart could have fired you without even accusing you of stealing. Unless you had a specific contract with Walmart that they somehow breached, you likely do not have a case.
