    one party consent rule videotaping without permission

    The owner of the company we worked for videoed and audio recorded us without us knowing. We were recorded in our office and there was no one else there. We said some things about the owner’s wife, who is the company’s book keeper, that he didn’t like which is what led to our termination. We never gave consent to be audio recorded verbally, written nor was it disclosed in our employee handbook. Is it legal to audio record without consent in the workplace? Everything I have read says NC has a one party consent rule N.C. Gen. Stat 15A-296. I would really like to know what is legal and what is not in regards to this matter. Your help would be most appreciated.

    You will want to consult directly with a knowledgeable local employment law attorney.

    FWIW, if the statute in question forbids surreptitious video and audio recording, then your employer may have breached the law by secretly recording you and your coworkers, and you may have legal recourse. Again, though, you want someone familiar with the statute in particular and the NC courts in general to provide you with a more informed opinion.
