    Intermittent FMLA and Work Excuses in West Virginia

    Can an employer require to provide a doctor's excuse if my intermittent FMLA leave lasts 3 or more days? They have a leave policy that states that an employee absent from work due to illness for 3 or more days must provide a doctor's release to return to work. Must I provide an excuse for intermittent leave absences that are 3 or more days because of this policy?

    Only if you want to avoid possibly being fired for breaking the policy. They are only trying to ascertain what you actually were off for. Otherwise, you could just go on vacation.
