Transfer and reducing salary by 60% without telling new salary for two months

    Hello Mam/Sir,

I am from India and I was working in US. I was transferred to India but my company didn't tell me the salary for India even after my regular follow up till the day I was supposed to travel. I travelled to India on 6th September and I kept getting paid my US salary till 15th October. On 16th my company told me that my salary in India will be $33K compared to my US salary of $120K. They also said that my salary for September and upto 15th October will be reveresed as per salary offered in India. I told them that this is not acceptable and I don't want to be transferred. I told them that if I had known that salary in India will be so low then I would not have accepted the transfer. I told them that I want to return to US and resign from services of my company after 15 days. They asked me to hold on and they will get back to me and so I withdrew my resignation. They still didnt pay me salary on 31st October and the HR person discussed with me on 1st November that the new salary offered will be about $36K-$40K depending on my acceptance. I told them that this is not acceptable and I want to return to US and will like to resign from 1st December. They said that I can't this and also that my salary will be reversed as per whatever they have finalized. After lot of discussion they are telling me that 4th of Novermber will be my last working day. I told them that I have resigned to be relieved from 1st of December and not 4th of November.

I want to know my right in this case. Can my company force whatever salary they want after the period is over without telling me about it in advance? Can they make me leave without completion of the notice period which I have given during my resignation?

The company can likely fire you at any time, regardless of what you stated during your resignation unless you had a specific contract to the contrary. As far as your reduction in salary, that is something you should have discussed with your company. I am not sure whether they can retroactively reduce your salary and that is something you should discuss with a local employment attorney.

This is standard practice. I am not sure where in the US you used to work, but in most major cities in the US, 120K would provide a similar standard of living as 33K in India. You cannot reasonably expect your company to provide you A US salary while having you work in a country where the power of money is 10 fold. They are providing you with an equal lifestyle. You are always free not to take it, and find another job. It was also your mistake that you did not finalize your terms of employment before you transferred half way around the world.
