I am trying to either A) get the employee back to work or B) discharge the employee so that a new employee can be hired to replace them.

The reason I cannot just hire someone to replace the out employee temporarily is because my agency is funded through the state of New Jersey and the state will not approve the hiring of another employee above what we are approved for. So I need this person to return to work or leave so that my agency can return to normal operations.
