Social Security Beneficiary payments
Hello. My ex-husband and I went to court for custody proceedings. The court put into place a GAL for the children. My ex-husband receives social security for disability. The GAL gave the court recommendations that stated the children were to reside with me for the school year and with him for the summer due to him not being employed. The social security benefits were to follow the children wherever they went. ( No problem on my part) During the summer months my ex-husband stopped receiving the benefits as did our children as well; then in December I received a lump sum because his benefits were re-instated. My ex-husband contacted me and told me that I owe him for the two months during the summer when the children were there. Is this true? Or is it that the benefits still stay with the children since they are currently home with me, and it was not until 5 months later that the benefits were received. Please help.

Based on what you have said, it appears you owe him money for the 2 months when he had the kids because the social security benefits follow the kids and he should have been receiving them in the summer because he had the kids at that time.
I am not a lawyer, this is not legal advice.
