    am I married

    I have lived on and off in Idaho with a women since 1987. We have never been married. In 2006 she filed for devorce with no record of marriage. This meant she first had to prove marriage. She did not follow through and case closed as inactive. In 2012 she has refiled the case. I want to use the defence that she has not filed the case in the alloted 4 year time frame and can no longer file. Title 5-217 Idaho Code

    I don't think that there would necessarily be a statute of limitations on a divorce case. However, without knowing fully the details of your situation, it's hard to say. Have you contacted a family law attorney in Idaho? If you click that link there, you'll be taken to a page and you can choose your city or your area. Also, on this page or that page, you'll see some ads for family lawyers probably. These lawyers will be hungry to represent you aggressively. And if it is the case that your ex gf is trying to basically get half of all you own, then it would really be wise for you to contact a family law lawyer who can represent you effectively. She has probably gotten a lawyer it sounds like, so if you don't have one, you will be at a disadvantage.

    You might be able to bluff her into not continuing with the case using that title 5-217, but I don't think that it applies here to this situation.

    Anyway, get me more information, we'd like to help.
