    Post Divorce Help

    Married 051200. Separated 050110. Divorce 101910.

    Ex & I were working on a peaceful settlement to "save money" from court. She had attorney. I didn't (dumb). I was talking to her (Discussions of how to workout details) and seeing our daughter almost daily through first of November 2010. After returning from taking our daughter home during the 2nd week of November 2010, I discovered the divorce decree in my mailbox. She and her attorney didn't even tell me of the hearing. I live blocks from courthouse. From time she said she wanted a divorce to early 2011, I was under my physicians care & seeing a psychologist for clinical depression, due to losing my family.

    She had opened a savings acct in only her name, depositing some $40k from my earnings. She cut me a check for $10k when I had to move out. She then closed the acct and kept all that community property. $8k lavished her parents and brother on trip to Mexico. Gave $10k to parents. Texas is typically 50:50 regarding community propert.

    Would "fraud on a spouse" apply here, that would allow for appeal? Since I was not present to defend myself & interests, she was awarded all community property. She even had written into the decree that our daughter, at age 18, gets 50% of my small business.

    Is there a legal avenue (outside of an expensive appeal) since she closed that savings acct and gave our money away?

    Was there a hearing regarding the property and divorce settlement? They would not have a hearing without you unless you were properly served and did not appear at the hearing voluntarily. No matter what avenue you choose to pursue, it will involve some type of lawyers and litigation. You can try to contact your local BAR association and ask them for a referral to a free civil law clinic in your area.
