    EX wants to keep griping about same issues

    my ex and I were divorced in 2009. During the divorce he wanted to use that I was smoker against me and a reason I should not be the primary residential custodial parent. he lost this argument in divorce court because he is also a smoker. We went to mediation in May 2011 and he was raving over the smoking again. again, he was told there was nothing to argue about here because he is also a smoker. I was told by my former attorney this would never be an issue again. 12 days after mediation he was sending me text messages threatening me with taking a polygraph over smoking in front of our son. I told him simply polygraphs were not admissible in court. Can he ever take me back to court over this smoking issue which has been heard twice now in front of judges?

    In order to request a modification of a child custody order, there needs to be a change of circumstances. There does not appear to be any such change here so I would not worry about it. The best thing you can do is ignore his messages.
