    Clueless

    I had back surgery in April. I found out today that my husband has been calling in refills for a pain med prescribed to me and taking those himself. I don't want this on my record but I don't want him to be legally in trouble. He is being dropped off at rehab tomorrow. Can I legally be in trouble since this is in my name?

    In order for you to be criminally responsible there has to be some intent or at least knowledge on your part. I wouldn't loose sleep over the possiblility that you will face charges. I do not think it would be a good idea for you to take a bullet for your husband either, if it comes to that. Generally judges want to see that people in your husband's situation are taking the appropriate action to remedy their problem so that they do not become a threat to themselves or society. I would be surprised if the authorities would be inclined to take any action in a case like this.
