    Unhappy Property fell through mortgage denial; Attorney & Title Company wants full Payment

    I received a denial letter from the mortgage company, which was forwarded to the Attorney’s office. My Attorney then informed me that he now charges $1350 per closing. I thought we were under the previous agreement of $1000 per closing. In previous transaction Attorney stated he would not be able to protect us in a closing because seller wanted to stay in property after closing and suggested we back out. The Attorney charged us $400 and stated he would deduct from future transaction. I informed of previous deal and he stated we own him $950 for the transaction and $500 for the Title Company as a cancellation fee. I asked the Attorney why would he order title (takes one week to receive) before I get approved for a mortgage? Attorney stated it was standard procedure, in which I didn’t agree. Attorney has been holding my down payment check over $10,000 for five weeks, until I agree to his terms. Is there anything you can suggest to handle situation.

    The best thing I can suggest is to contact your local bar association and tell them your story and ask them whether the attorney acted lawfully.
