    improvements made to property that has been leased, lease not renewed

    We are a non profit baseball organization who has been leasing property from a school district for aprox. 15 yrs. We have been told our lease will not be renewed by the new school board and will be leased to a new tennant who will use the property for the same pourpose as we did, baseball. We have made numerous improvements to the fields including fencing and backstops as well as drainage issues and sod just to name a few of the more costly improvements. Is there any compensation we have a right to since the new tennant will benifit from the improvements for their baseball organization?

    It may be possible for you to remove some of the items if you wish, however otherwise you are not entitled to any compensation. Tenants constantly make improvements but it is at their own expensive.

    What can we remove? Fences and dugouts are somewhat permenant however, can be removed with force. Can we remove them? We would most certainly like to take anything we can without breaking the law. It seems very unfair for someone else to benefit from all the money and hard work that has been put into the fields. I appreciate your help. Their are over 100 kids and families that are very upset over this situation.

    You should pursue this issue at the school board meeting. Try to generate media involvement.

    Usually you can remove items that are easily removable, not fixtures that are attached or would cause damage to the property. I see why it may seem unfair but this is very common and happens all the time. You know that when you entered the lease you would have to give up the property eventually. Businesses spend all kids of money renovating their property to start operating a business but once the lease terminates, unless the landlord renews, they lose whatever amount they put into the business. It is part of the starting/operating expenses when entering a lease, which is why most people prefer long leases.
