    Is this a real estate trap?

    A prospective buyer of a home (who is a lawyer) requested of the seller (an elderly woman who is NOT a lawyer) to sign an agreement assuring sale of the home only to the buyer (agreed to be cash in total). The seller refused to sign this agreement after some convincing by family and ultimately verbal advice from another attorney. The buyer has now gotten the seller to agree to allow the buyer to plant one of her prized fruit trees onto the property in anticipation that the seller will sell to her, although no contract has even been drawn up, no funds exchanged, and no confirmed verbal agreement to sell as yet has been made. The seller doesn't think allowing the planting of the tree is a big deal and it is at the potential buyer's risk if she chooses to plant this tree. I am concerned about some kind of implicit agreement in the allowing of this tree to be planted on property not even close to being officially sold. What do you think?

    I do not see any issues here. Whomever purchases the house will get the house and this prized tree.
