    House Sale after Divorce.

    Im legally divorced now for a year, unfortunately our home burned down in the middle of it being sold in a short sale. the house is now rebuilt and my ex wants to move back in with new family. we
    owe more than house is worth, im surprised it hasn't gone into foreclosure. in our divorce it states house is to be sold but he seems to think he can afford it if i agreed to sign a loan modification. how can i get my name off this night mare? PLEASE ADVISE AT LEAST WHO I SHOULD GO TO!!!!

    Terry,
    If you sign on to the modification you will still bear responsibility for the house payments as you will be a party to the modification. It would solve your problem if your X would re-finance the house, that would create new paper with new obligations. I would hold firm. Decline the modification but support a refinance, meaning if you signature is required to facilitate a refinance, cooperate.

    If you have a quick claim, it can be filed and the house will be 100% in your name. But talk with a Realtor
    and they will be able to tell you exactly what steps and paperwork have to be completed, it'll vary from state to state.

    If you have a quick claim, it can be filed and the house will be 100% in your name.
    But talk with a realtor and they will be able to tell you exactly what steps and paperwork
    have to be completed, it'll vary from state to state.

    If you want to have a quick claim, it can be filed and the house will be in your name.Even so, talk with a realtor or boca raton real estate attorney and they will be able to tell you exactly what steps and paperwork have to be completed. They work according to the clients desire and wants.
