    DUI in Parked Car

    Is it possible to get a DUI if you are sitting in a parked car, in the driver's seat? I have heard that this can happen if you do something like take a nap in the driver's seat before leaving but maybe it's an urban legend?

    In Florida you can get a DUI while sitting in a car. It doesn`t matter if the keys are not in the ignition because there is always the chance you may wake and drive before you are sober enough.

    I had heard this as well. Is this only true if you are sitting in the driver seat? If you have the keys in your possession but are napping in another seat, for example, could you still get a DUI?

    Possibly. It will depend on what the judge/jury consider being in possession of the vehicle.
