    If he has standing to sue, then sure why not? He does not need to notify anyone except the opposing party whom he must serve.

    The husband can begin estate litigation without the consent of the wife, but it is unlikely that he will be able to keep it secret from her for too long. Contact an estate litigation or probate attorney.
